Chapter 7

In order to file a Chapter 7 bankruptcy, an individual must qualify by passing the “means test”.  The means test determines how much, if any, disposable income a person has to repay their debts.  If a person is under the median income for their state and household size, they may qualify without having to go through the means test.  If there is no disposable income after taking the means test, then a chapter 7 can be filed.

A chapter 7 bankruptcy is generally a short lived bankruptcy.  There is no restructuring or reorganization.  In a typical chapter 7 case, the debtor receives a discharge and the case is closed within approximately 90 days.
